We are having some debate in out office. If a gift aid form declaration come in after a gift has been processed, i.e. the check is in the bank, can
the gift aid still be claimed?
Does anyone have an ideas.

Providing the wording on the declaration covers the time-period that the
donation was made in tax can be reclaimed. eg" All donations made since
April 2002" or "Including the donation made on 28 March 2002"

If it is associated with the gift, or the declarlation indicates all
gifts on or after 6 April 2000 the answer is yes

If doesn't matter what date the Gift Aid Declaration (GAD) arrives at your
office, what matters is the date which the donor has said all donations can
be claimed *from*. I.e. preferably this should be something like "all
donations since 6/4/2000 and all donations hereafter until I inform you
otherwise". This means that even if you have received one or many donations
from this donor since 6/4/2000, you can 'back-claim' them all for Gift Aid
(and, of course, all future donations).

3.10.2 Donors will be able to give the charity a declaration:
in advance of their donation, at the time of their donation, or at any time
after their donation (subject to the normal time limit within which tax can
be reclaimed - normally around six years)
to cover a single donation or any number of donations
in writing (e.g. by post, by fax or electronically through the Internet) or
orally (e.g. over the phone or face to face).

my understanding is that you can claim after banking the cheque so long as
the donation was made after the beginning of april 2000 when the new giftaid
rules come in.
We often receive donations from new donors who we subsequently follow up
with a giftaid declaration request.

Should be no problem - you have up to six years to get a declararation
against a gift or range of gifts. Check out the details at

Yes, it can be claimed is the short answer. We have a system whereby on
receipt of the donation a gift aid declaration form is sent out to be
completed and returned. The processing and banking occurs as normal. Once a
gift aid declaration has been completed all donations received by that
particular individual can be added without having to send further
declaration forms to be signed.

Yes. A properly composed Gift Aid Declaration makes it clear that once
you've received it (the Declaration) you can claim Gift Aid on any and
all donations from that donor back to April 1st 2000! Check the

Gift Aid can be reclaimed retrospectively up to six years after the gift
