A question about budgets

I just have a quick question.

In the funding application, you specify that you will pay £5 per hour to a sessional worker.

However, once you receive the funding, can you pay £7 to this sessional worker (because you still have some money left)??

I am not a lawyer - but as I understand it:

- check your trust deed - some specifically exclude such situations, in which, none of the trustees/management committee can be paid.

- if the trust deed does not exclude trustee payments, then you a) need to check with the Charity Commission and b) the trustee concerned may NOT "vote" or be part of the decisions relating to their payments. Which means, really, that it is not ideal for a Chair to also be a sessional worker.

As far as your second question goes - not sure what employment law specifies. Even if no contract is required, it might be a good idea to do an agreement which the trainer and your group both sign, so there is an understanding of expectations.

As a new group, your first and best resource is your local volunteer centre/CVS - if you haven't been in touch with them, then it's worth getting to know them as soon as possible.

Thanks for the replies. Actually, we are beginners in fundraising and charity work, so we bound to make mistakes.

I just a have a another quick question.

(1) If a person is a chairperson of a group, can he also be a sessional worker and get paid to run the sssions?

(2) We are small group and we are going to run 3 hour workshops for 2 months. Do we need to have a employment contract with the person who will be running the workshops?

Hmmm, you say you are paying your sessional worker £5.00/hour - isn't that below minimum wage? And do their wages take them above the National Insurance threshold? If so, then the charity will incur employer's NI, which would make the total cost to the charity of employing the worker about £7/hour.

Though it is acceptable to have someone's hours or even continued employment to be dependent on funding.

Funding cut, have to cut costs.
Many charities seem to cut their fundraisers first (which I find highly amusing) to cut costs.
But to balance the books, having contracts written that are dependent on funding can help.
Few people are happy about cuts in hours or job ending, but sometimes necessary for the organisation.

I've never heard of this before. Anfd if you get less money would you reduce the salary accordingly? There are basic employment rights issues here.

Levels of pay relate to the requirements of the job and your ability to recruit to the post - not whether you will be able to attract some funding. What new or increased funding could do is allow you to pay the person for more hours a week or extend the project over a longer period. It's not acceptable to vary a persons level of pay on the vagaries of fundraising.
