A Firm Foundation for Philanthropy? A discussion of recent developments in Switzerland impacting charitable giving and international philanthropy

Discussion leader: Benoit Merkt, Lenz and Staehelin, Geneva

Switzerland is the home for a growing number of charitable foundations. This is due to a number of factors, including the great freedom and flexibility in the organization of this entity, which is not yet subject to the supervision of a State authority. This session will examine these features and put them into perspective, while highlighting the main "hot issues" in the Swiss landscape, namely recent developments in corporate governance and the entry into force of the new Host State Act, which aims at creating a favourable environment for charitable foundations in Switzerland.
Discussion to include:
* The main features of the Swiss foundation and recent legislative changes of note in Switzerland
* Swiss foundation versus Swiss association: is there a choice to make?
* State supervision of Swiss foundations
* Corporate governance in Swiss foundations: developments and trends
* Switzerland's new Host State Act
* Transnational tax aspects from a Swiss perspective
